Development Assessment Panels

On 1 July 2011, State Government introduced legislation to implement Development Assessment Panels (DAPs). The Metro West Joint DAP (JDAP) applies to the Mosman Park area.

The purpose of DAPs is to determine the higher value development applications in place of Local Governments and their Elected Members.  Each DAP has five (5) members consisting of three (3) specialists and two (2) local government councilors.  A DAP is considered to provide a balance between experts and local knowledge in the decision making process whilst providing transparency, consistency and reliability.

In accordance with the new legislation, development applications now fall into three (3) categories:

Mandatory DAP Applications

Developments that are estimated to cost of $10 million or more, except for the following:  

  • Construction of a single house;

  • Construction of less than 10 grouped dwellings or multiple dwellings;

  • Construction of carports, shade sails, outbuildings or sheds;

  • Development in an improvement scheme area;

  • Development by a local government or by WAPC                        

These development applications must be determined by the relevant Development Assessment Panel and cannot be determined by the Town.

Optional DAP Applications

Developments that are estimated at a cost between $2-10 million except for the following:

  • Construction of a single house;

  • Construction of less than 10 grouped dwellings or multiple dwellings;

  • Construction of carports, shade sails, outbuildings or sheds;

  • Development in an improvement scheme area;

  • Development by a local government or the WAPC

The applicant can choose whether to have their application determined by a Development Assessment Panel or the Town.

Applications can be determined by the Responsible Authority (the Town)

Developments that are estimated at a cost between $2-10 million except for the following:

  • Construction of a single house;

  • Construction of less than 10 grouped dwellings or mulitple dwellings;

  • Construction of carports, shade sails, outbuildings or sheds;

  • Development in an improvement scheme area;

  • Development by a local government or the WAPC

 The Town will decide whether the application will be determined by the Town or by a Development Assessment Panel not the applicant, which will be considered on a case by case basis.

Lodging a  DAP Development Application

A standard application for planning approval must be e submitted to the Town consisting of:

  • The Towns Development application form (signed by the owner)
  • The relevant checklist;
  • Application fee;
  • Three (3) sets of plans (as itemised on checklist);
  • Certificate of Title;
  • Electronic copy of plans (CD or memory stick);
  • Any other supporting information.

In addition to the above, the following shall also be provided:

  • DAP application form;
  • DAP application fee;

The Town carries out the preliminary assessment of the application which may include referring the application to other relevant bodies, advertising the application, reviewing submissions and preparing the Responsible Authority Report (RAR) with a recommendation for the DAP. The DAP takes the recommendation from the Town into account when determining the application.
